These Terms and Conditions are entered
into by and between GreenMerits Consulting Incorporated (hereinafter "Company")
and YOU (hereinafter "Client").
Services Provided.
Company will create a three page website using textual information and computer
files received from Client, submitted via the MSC
site.
Service
- Company holds the right to accept
or reject the provision of the MSC service to Client.
Terms of this contract/service commence upon the time of Client signup to
upload of site files to server.
- Four day MSC completion time
frame is dependant on Client returning/replying to any calls or requests for information
within 12 hours of initial request.
Replies must be communicated either via phone or email.
- Wording/language used on each
of the pages created during the MSC service is at the discretion of Company. Client will have the opportunity during
the editing day (day three) to submit textual and colour changes they would like to see.
These changes will reflect the final revision that is placed on Clients site
upon completion.
- Site layout and HTML tags are
to be created at the discretion of Company
Pricing
- Price listed for Company’s
Mini Site Creation (MSC) service is subject to change without notice.
- Total cost of MSC service is
$299, broken down as follows:
- $180.
This initial payment for MSC service is non-refundable as it is passed onto a
third party for the purchase of website space and domain name creation
- $119.
Remaining payment amount is an hourly charge based on $23.80/hr for five hours totaling $119 due at onset of service. Hours
(and their associated costs as per the above mentioned rate) accumulated in production
of site are non refundable.
- 1 hour of free site technical
support/training will be provided by GreenMerits upon completion of the site.
MSC Form
- Contact information provided
on MSC
site is the primary contact information to be used by Company with Client.
Changes to contact information must be communicated to Company via phone
or email.
- Images/files received on MSC
site will be automatically deleted if they contain malicious software or inappropriate content.
Company will communicate this to Client in order to come up with another
method of acquiring valid files and information.
Scope
- Projects that fall outside the
scope of the MSC service (in terms of additional functionality and/or layout customization)
will fall into Company’s custom web development service, and will be subject to
its prices, terms and conditions therein
- Post completion Company is not
responsible for maintaining updates on Clients website.
Such updates are outside of the MSC service and as such are subject to prices,
terms and conditions of Company’s website maintenance service.
Legal
- Client may only use Company’s
service in lawful manner in accordance with municipal, provincial and federal regulations
- Images/files provided to Company
for placement on site are owned by and subsequently the responsibility of Client
- In no event shall Company have
any liability or responsibility for any special, indirect, incidental, consequential
or exemplary damages, or for lost data or lost profits, in each case regardless
of the form of action (whether in contract or in tort or otherwise) arising out
of or in connection with this contract or the transactions contemplated hereby,
even if such party has been advised of (or knows or should know of) the possibility
of such damages.
Acceptance
- By submitting your sign-up form, you indicate acceptance of the terms and conditions of this contract by Client.
